In the case of APPLEGATE CONDOMINIUM ASSOCIATION, INC. v. APPLEGATE ESTATES, LLC Et Al your lawyers, Zeldes, Needle & Cooper, PC, filed a motion yesterday that will accelerate this case as well as the fees you will be paying them.

On January 20, 2026 Mastrianni’s lawyers filed a Request to Revise looking for dates when the cause of action accrued so they could have the case thrown out on account of being filed beyond the statute of limitations for these matters.

After no response a Motion for Nonsuit for Failure to Plead was filed May 13, 2026 and a hearing is set for October 26, 2026.

After over six months Zeldes, Needle & Cooper, PC finally filed a Revised Complaint on July 27, 2026 and on July 30, 2026 they filed a Request to Amend the Revised Complaint.

Not having heard from Mastrianni’s lawyers yet a Motion for Default for Failure to Plead was filed on September 1, 2026.

This is all legal gamesmanship and of some interest to followers of the sport but, from a purely practical standpoint, I figure it adds another $25,000 to the billable churn.
