Hello Nepenthe Neighbors,
In the next few days, you will receive ballots for a Recall of Director Christina George. Her recall is the result of her violation of the Associations Bylaws, ignoring her fiduciary responsibilities and self-dealing. Her activities reflect an attitude that has permeated the whole Board*, an arrogance and disregard of the rules when conducting the Association’s business and a disrespect of any member who would question their actions. This is a very important election and I urge you to vote “YES” to recall Director Christina George.
The Board has consistently ignored the law and our Bylaws by failing to provide meeting notices and conducting business in Executive Session secrecy. Executive Sessions are to be used to protect privacy not to HIDE the Board’s activities. When questioned about these transgressions, they support their actions as permitted “on advice of counsel”.
The most recent and egregious example of “ignoring the law” was their response to the filing of the petition for recall of director George. Although assured by their attorney that it was valid and to proceed, they decided at a December meeting that it was without merit and voted to reject it.
During the six month intervening period, the recall petitioners worked continuously to reinstate the election. The Board, stonewalling, resisted every effort. Having no other recourse, petitioners obtained legal counsel and prepared a lawsuit against the Board. As part of this process, we were required to offer mediation and the Board refused. Their delaying tactics have unnecessarily run up legal fees.
In May, they changed their mind and declared, “The Nepenthe Board has determined that proceeding with the recall election that has been on hold is in the best financial interest of the community.”
Neighbors, it is time we changed the Board’s attitude.
It is time they conducted all business in open session as required by law.
It is time they provide for members’ questions and comments prior to making decisions on major issues and expenditures.
It is time we sent them a message by voting yes to recall Christian George and bring back accountability and transparency to our Association.
